1. Who we are and how to reach us

2. What the Service does

Bandeha is a platform for the padel community. Players can create profiles, form doubles teams, submit and confirm match results, browse clubs, and read news. Clubs can create a verified club profile, be listed in the directory, and publish news. We may add, change, or remove features over time. Some features are offered in phases and may be limited, in testing, or not yet available.

3. Eligibility

You must be at least 15 years old to create an account. If you are between 15 and 18, you confirm that your parent or legal guardian is aware of and agrees to your use of the Service. By using the Service you represent that the information you provide is true and that you are legally able to enter into these Terms. Club accounts must be created and managed by a person authorised to act on behalf of the club.

4. Your account

• You are responsible for the accuracy of the information you provide and for keeping it up to date.
• You are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us promptly at the address above if you suspect unauthorised access.
• You may not create an account using someone else’s identity, impersonate another person or club, or use automated means to create accounts.
• We may require you to verify your email address before you can use certain features.

5. Player and club accounts; club verification

The Service has player accounts, club accounts, and administrator accounts. Club accounts are subject to verification: until a club is verified by us, its access to club features may be restricted. We may verify, decline, suspend, or revoke the verification status of a club at our reasonable discretion, for example if information cannot be confirmed or these Terms are breached. Verification indicates only that we performed a basic check; it is not an endorsement or a guarantee about the club.

6. Your content

You may submit content to the Service, such as profile details, avatars, club information and logos, match records, and news posts ("User Content"). You retain your rights in your User Content.

By submitting User Content, you grant Bandeha a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display and distribute that content solely to operate, provide and promote the Service. This licence ends when you delete the relevant content or your account, except where the content has been shared with others who have not deleted it, or where we must retain it by law.

You represent that you own or have the necessary rights to your User Content and that it does not infringe anyone’s rights or violate any law. You must not upload logos, images or text you are not entitled to use.

7. Teams and match results

• A team is a doubles pair. Team invitations must be accepted by the invited player before the team is active. A player may belong to a limited number of active teams.
• When a match result is submitted, it remains pending until a member of the opposing team confirms it. Once confirmed, the result becomes final and immutable and cannot be edited or deleted through the Service. Submit results carefully and only confirm results you agree are accurate.
• You must submit only genuine results for matches that actually took place. Falsifying results, colluding to manipulate records, or submitting results for matches that did not happen is prohibited and may lead to suspension.
• Match records are provided for the community and are not an official competition ranking unless expressly stated.

8. Acceptable use

When using the Service, you agree not to:

• break any applicable law, or infringe the rights (including privacy and intellectual-property rights) of others;
• post content that is unlawful, defamatory, harassing, hateful, obscene, misleading, or that harms minors;
• harass, threaten, or abuse other users, or collect their data without a lawful basis;
• upload malware or attempt to gain unauthorised access to the Service, other accounts, or our systems;
• probe, scan, overload, disrupt, scrape, or reverse-engineer the Service, or bypass access controls or verification;
• use the Service to send spam or unsolicited communications, or for any fraudulent or deceptive purpose.

9. Our intellectual property

The Service, including its software, design, text, graphics, and the Bandeha name and logo, is owned by Bandeha or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable licence to use the Service in accordance with these Terms. No other rights are granted.

10. Third-party services and links

The Service may link to, or rely on, third-party services (for example email delivery, image hosting, and external websites such as club websites). We are not responsible for third-party services or content and their use may be governed by their own terms and privacy policies.

11. Availability and changes

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue all or part of the Service, and may impose limits on certain features, at any time. Where changes materially affect you, we will give reasonable notice where practicable.

12. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including as to merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that content submitted by users (including club information and match results) is accurate, complete, or reliable. Nothing in these Terms limits any rights you have as a consumer that cannot be limited or excluded under mandatory applicable law.

13. Limitation of liability

To the fullest extent permitted by law, Bandeha will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill, or opportunities, arising out of or related to your use of, or inability to use, the Service. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable law, including mandatory consumer-protection rules.

14. Indemnity

To the extent permitted by law, you agree to indemnify and hold Bandeha harmless from claims, damages, and reasonable costs arising from your breach of these Terms, your User Content, or your misuse of the Service. This does not apply where you are acting as a consumer, except to the extent your liability arises from your intentional or negligent breach.

15. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your account, or restrict your access, if you materially or repeatedly breach these Terms, if required by law, or to protect the Service or other users. Where we do so and you are a consumer, we will act proportionately and give notice and reasons where practicable. Sections that by their nature should survive termination (including content licences already granted to others, disclaimers, liability limits, and governing law) will survive.

16. Governing law and disputes

These Terms are governed by the laws of the Republic of Serbia, without regard to conflict-of-laws rules. The competent courts of the Republic of Serbia have jurisdiction over any dispute. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you may bring proceedings in the courts that mandatory law makes available to you. Consumers in the EU may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

17. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "last updated" date and, where appropriate, notify you through the Service or by email. Changes take effect when posted (or on a later stated date). If you do not agree to the updated Terms, you should stop using the Service and may close your account.

18. General

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or successor. These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and us regarding the Service.
